The Company and third parties own several trademarks displayed on the Website. No element contained in the Website may be interpreted as granting anyone a license or right to use any logo, design, or trademark belonging to the Company or a third party.

Submissions

Subject to the terms of the Privacy Policy regarding the use of the Website and the Company’s programs/services, if applicable, when the User submits messages, data, texts, photographs, images, and other materials to the Company, they grant the Company a worldwide, irrevocable, non-exclusive, perpetual, and royalty-free license: i) to use, reproduce, store, adapt, translate, modify, create derivative works, transmit, distribute, or make this content available to the public for any purpose; and ii) to sublicense to third parties the unlimited right to exercise any of the aforementioned rights. In addition to granting the aforementioned license, but subject to the terms of the Privacy Policy regarding the use of the Website and the Company’s programs/services, if applicable, which take precedence, the User hereby: i) waives all moral rights in their content; ii) consents to their name and address appearing for this content, if applicable, as well as to the disclosure or display of this information; iii) acknowledges and agrees that the Company shall not be liable for any loss, damage, or corruption of the User’s content; and iv) acknowledges and agrees that the submissions they transmit for display on the Website or that they submit to the Company will be considered non-confidential.

The User declares and warrants to the Company that: i) their content is original; ii) their content does not violate any intellectual property rights, including copyright; iii) they are the sole holder of all intellectual property rights, including copyright, in their content, or, if applicable, they have obtained written permission from the rights holder to submit their content; iv) their content does not violate any third party's right to privacy or image; v) their content is truthful, accurate, up-to-date, and complete to the best of their knowledge; vi) their content is not illegal; vii) their content does not contain defamatory or insulting statements.

The Company has no obligation to verify the content residing on its Website or that is transmitted to it. However, the User acknowledges that the Company may verify the Content at any time, particularly to comply with a law, regulation, decree, or request from authorities, to ensure the proper functioning of the Website, or for any other reason at its sole discretion. The Company reserves the right to modify, refuse, or delete any Content residing on its Website or that is transmitted to it if the Company believes, at its sole discretion, that this Content violates these terms of use.

Integrity and accuracy of information and access to the Website

The Company strives to ensure that the information and Content available on the Website are complete, accurate, and up to date. This information and Content come from sources that the Company deems reliable and are regularly updated; however, despite all reasonable efforts, they may still contain inaccuracies, omissions, typographical errors, or other shortcomings. All displayed prices are in Canadian dollars. Despite the Company's efforts to be as accurate as possible, the price of a product listed on the Website may be incorrect. If the displayed price of a product is found to be incorrect on the Website, the Company reserves the right to either correct the price or cancel a sale made on the Website, at its discretion.

Compensation

At its request, the User agrees to indemnify and hold harmless the Company, its affiliated entities, partners, subsidiaries, or licensors, as well as their employees, contractors, agents, and executives, in the event of any claims against their liability, as well as any claims and costs (including the extrajudicial fees of their legal advisors) arising from the User's use or breach of obligations in relation to the use of the Website or breaches of its obligations mentioned in these terms of use. The User agrees to cooperate with the Company in its defense in any claim for which the User should provide indemnification.

It is the User's responsibility not to leave the computer, tablet, or phone used to access the Website unattended and to close them properly.
